1. Agreement

These Terms of Service (the “Terms”) are an agreement between you and Hemlock East LLC (“Hemlock East,” “we,” “us,” or “our”). They apply to your use of this website and any applications we publish (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

2. License to use our apps

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use our apps on Apple devices that you own or control, for your own personal, non-commercial use. Apps distributed through the App Store are also subject to Apple’s applicable terms, including the Licensed Application End User License Agreement.

3. Acceptable use

You agree not to:

• copy, modify, reverse-engineer, or attempt to extract the source code of our apps, except to the extent the law permits;
• resell, sublicense, or otherwise commercially exploit the Services;
• use the Services to break the law or to infringe the rights of others; or
• interfere with or disrupt the integrity or security of the Services.

4. Intellectual property

The Services, including their design, text, graphics, and software, are owned by Hemlock East LLC and are protected by intellectual property laws. The names “Hemlock East” and our app names and logos are our trademarks and may not be used without our prior written permission. These Terms do not grant you any rights other than the limited license described above.

5. Your content and data

Content you create in our apps belongs to you. As described in our Privacy Policy, our apps are designed to keep that content on your device. You are responsible for maintaining your own backups where that matters to you.

6. Apps in development

Some of our apps are in active development and may be offered as pre-release or test versions. Pre-release software may be incomplete, may change, and may contain errors. It is provided for evaluation and is not guaranteed to be available or supported.

7. Disclaimer of warranties

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Our apps are not medical, navigational, or safety devices, and you should not rely on them as such.

8. Limitation of liability

To the fullest extent permitted by law, Hemlock East LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, for the Service giving rise to the claim.

9. Changes to the Services and Terms

We may change, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above. Your continued use of the Services after a change takes effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the United States and the state in which Hemlock East LLC is organized, without regard to conflict-of-law rules.
